Terms of Service

1. Agreement to Terms

By engaging Build by Igoe for web design, web development, AI readiness consulting, or any related services, you agree to be bound by these Terms of Service. These terms apply to all clients, project inquiries, and ongoing service agreements.

If you do not agree with any part of these terms, please do not proceed with an engagement.

2. Services Provided

Build by Igoe (operated by Brayden Igoe) provides the following services:

  • Custom website design and development
  • AI readiness audits and structured data implementation
  • Web application and custom tool development
  • Landing page design and deployment
  • Ongoing website support and maintenance

All service scope, deliverables, and timelines are agreed upon prior to project commencement and documented in a project brief or service agreement.

3. Payment Terms

Payment terms vary by engagement type:

  • Monthly plans: Billed on a 12-month annual agreement. Payment is due at the start of each monthly period.
  • Project-based: A deposit (typically 50%) is required before work begins. The remaining balance is due upon project completion and prior to final delivery.
  • Late payments: Work may be paused on accounts with outstanding invoices beyond 14 days. I'll always communicate before any service interruption.

4. Ownership & Intellectual Property

Upon full payment of all amounts owed, the client receives full ownership of all deliverables, including source code, design files, and written content created specifically for the project.

For monthly subscription clients, full code and asset ownership transfers upon completion of 12 consecutive monthly payments. Cancellation before 12 months results in no penalty, but ownership does not transfer. The client retains the right to cancel at any time with no cancellation fee.

Build by Igoe retains the right to showcase completed work in its portfolio and marketing materials unless a written confidentiality agreement is in place.

5. Client Responsibilities

To meet agreed timelines, clients are expected to:

  • Provide required content, assets, and feedback in a timely manner
  • Respond to communication within 48 hours during active project phases
  • Ensure they have the right to use any content, images, or assets provided for the project

Delays caused by client inaction may affect the project timeline, including the 7-day launch guarantee.

6. Revisions & Scope Changes

Each project includes a reasonable number of revisions within the agreed scope. Significant changes to scope after work has begun may require a revised timeline and additional cost, which will be discussed and agreed upon before proceeding.

7. Cancellation Policy

For monthly subscription clients: either party may cancel at any time. The client will not be billed beyond the current billing period. No cancellation fee applies. Full code and asset ownership transfers only upon completion of 12 consecutive monthly payments. Partial completion does not trigger an ownership transfer.

For project-based engagements: if a project is cancelled after work has begun, the deposit is non-refundable. Any additional work completed beyond the deposit amount is due at cancellation.

8. Limitation of Liability

Build by Igoe is not liable for any indirect, incidental, or consequential damages arising from the use of delivered websites, applications, or services. This includes but is not limited to loss of revenue, business interruption, or data loss.

Total liability is limited to the total amount paid for the specific service in question.

9. Third-Party Services

Projects may incorporate third-party platforms (Google Analytics, hosting providers, font services, etc.). Build by Igoe is not responsible for the terms, availability, or pricing changes of any third-party service.

10. Governing Law

These terms are governed by the laws of the State of Arizona, United States. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
